Thanks for using our products and services ("Services"). The Services are provided by Vesta Digital LLC dba hrundl.com ("Hrundl"), located at 19-21a Mtskheta street, Tbilisi 0179, Georgia. When you were signing up for hrundl.com Services, you were required to explicitly agree to the terms. If you do not agree - please do not use our services.

Our services

Hrundl is an employee monitoring service for tracking employee activity while working on company computers. The Service does not record keystrokes, nor accesses webcam and provides full control to the submitted data. Using in EU

You are prohibited from using Hrundl in EU or in any other country if it could involve collecting data for a EU resident. This is because of strict data protection laws (GDPR) in EU. While we are in full compliance with these laws as far as your personal data, we have no control over how you use the data you collect from others. While the responsibility for such data is fully yours, to avoid any potential liability for providing you with means to collect the data, we choose not to provide the Services at all in this case.

Compliance with local laws

It is your responsibility to comply with local laws and regulations governing employee privacy, monitoring and all others related to the use of the Service. While employee monitoring is generally legal, in many countries you are required to notify employees about using employee monitoring services. In some countries you may need a written employee's consent. In EU or anywhere where it concerns a EU resident’s data, it is your responsibility to comply with GDPR. Universally you can only install our Software on the computers that you or your company owns. These were just a few examples; your local laws may be different. You are forbidden from using the Service in any way that conflicts with your local laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.

Using our Services, Software

Don't misuse our Services. For example, don't interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software. You are responsible for maintaining the confidentiality of your Hrundl password and account. Furthermore, you are entirely responsible for all activities that occur under your account. Our Services display some content that is not ours, like comments in our blog. We do not monitor all of it and we are not responsible for such content. Children under the age of 18 are prohibited from registering for the Service. If you are using our Services on behalf of a business, that business accepts these terms.

Your Content

Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours. We do not monitor the nature or content of the data transmitted via the Service. And under no circumstances we will be liable for your content or any damage incurred because of accessing it. We only retain the data to provide you the Service and delete it either automatically when it gets old or when you cancel the Service or any time you request the deletion.

Modifying and Terminating our Services

We are constantly changing and improving our Services. We may add or remove functionalities or features, add new limits, change prices and we may suspend or stop a Service altogether. You can stop using our Services at any time. We believe that you own your data and preserving your access to such data is important. Further, Hrundl does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the Service

Limitation of liability, Indemnification, Severability, Governing Law

Hrundl, its' suppliers, distributors, officers, directors and employees, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary or punitive damages - anything arising out of or in any way connected with your use of the Service. The total liability of Hrundl its' suppliers, distributors, officers, directors and employees for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the Service. You hereby agree to indemnify and hold harmless Hrundl, its successors and/or assigns, as their interests may appear, against all liabilities, costs and expenses arising from any dispute, legal action or demand, related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees. If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein. These terms and conditions are governed by and construed in accordance with the laws of the State of Delaware, USA and you irrevocably submit to the exclusive jurisdiction of the courts located in Delaware, USA for the resolution of any disputes.
